A woman will be haraam for performing any of the following acts in a state of marriage.
If she is married to a man who is a polytheist or an idolater (such as is the case with many of today’s Christians), she will be haraam. She will be haraam for performing any marriage rite, whether oral or written, or any of the things that are done in the name of God. She will be haraam for performing any other ceremony that is performed without her knowledge or consent. The Prophet (S) said: “Whoever divorces his spouse, then, his marriage is invalid.” (Reported by al-Bukhari and Muslim.)
She will also be haraam at the discretion of her guardians. In the Prophet (S)’ case, as I have already made clear, it was the woman’s guardian who was in agreement with her. The Prophet (S) said to Umm Habibah: “O mother of the believers! Do you agree that your daughter should not be married to a man who is an idolater?” She replied: “Yes, for he may have married her if she said: ‘I will not go out of your house for a period of seven days.’ If he does not marry her, she is free.” (Reported by al-Tabari.)
She will also be haraam if she is married to a man who has a long line of wives. (Reported by al-Tabari.)
She will be haraam even if she is married to the Prophet (S). (Reported by al-Bukhari.)
He (S) divorced Umm Habibah after she had been married to him for three months. His wife and the men of his family did not know about the divorce. Umm Habibah said: “O Messenger of God, please tell them.” He did not say anything, but said: “She was my daughter so I divorced her after three months.” (Reported by al-Tabari.)
He (S) said: “Whenever the hand of any adulterer has reached the face of the daughter of a Prophet, she should be treated like a bride as long as she remains within the bounds of modesty, lest she be accused of committing adultery.” (Reported by al-Tabari.)
